Balsamo & Rosenblatt, P.C. successfully represented the Petitioner-Landlord, in a non-payment proceeding, by defeating Respondent-Tenant’s motion to dismiss and obtaining a judgment of possession by establishing that, even though the written lease between the parties expired, a month-to-month tenancy on the same terms as those as the original lease was implied since the Respondent-Tenant remained in possession after the expiration of the lease and continued to pay rent.
